1. Definitions

Studio / We / Us / Our means Gem Pilates Studio.

Client / You means any person attending classes, sessions, or purchasing services.

Services include Pilates classes, private classes, workshops, online content, and related offerings.
2. Eligibility and Health Requirements

By participating, you confirm that:

You are physically fit and able to undertake Pilates activities.

You have disclosed any injuries, medical conditions, pregnancy, or limitations prior to participation.

You acknowledge that Pilates involves physical exertion and carries inherent risks.

You agree to follow all instructor guidance and studio rules.
3. Medical Disclaimer

Our instructors are not medical professionals.

Pilates classes are not a substitute for medical advice, diagnosis, or treatment.

You participate at your own risk.
4. Limitation of Liability (ACL-Compliant)
To the maximum extent permitted by law:

We are not liable for any injury, loss, or damage arising from participation in our Services.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees under the Australian Consumer Law that cannot be excluded.
5. Bookings and Payments

All bookings must be made via our booking system.

Payment is required in advance unless otherwise agreed.

Class packs:

Are non-transferable
-
Have expiry dates
-
Are non-refundable except as required by law

6. Cancellation Policy

Cancellations must be made at least 24 hours before the class to avoid forfeiture of payment.

Cancellations within [e.g. 24 hours] may be charged in full.

No-shows will be charged in full.
7. Studio Etiquette
Clients agree to:

Arrive on time
-
Wear appropriate attire

Use equipment safely
-
Treat staff and other clients respectfully
We reserve the right to refuse service for unsafe or inappropriate behaviour.
8. Use of Tactile (Hands-On) Cues

As part of our Pilates instruction, physical or tactile cues (hands-on guidance) may be used to:

Improve technique and alignment
-
Enhance safety and body awareness
-
Assist with proper muscle engagement
-

Tactile cues will:
-
Be applied respectfully and professionally
-
Only be used where appropriate to the instruction
-
Be limited to what is necessary for safe and effective teaching
-

You may opt out of tactile cues at any time, either:

Indicating your preference on your New Client Form
-
Verbally during a session, or
-
By notifying your instructor or the studio in advance
-

If you choose to opt out, instructors will provide verbal or visual cues only, and this will not affect your ability to participate in classes.
We reserve the right to decline providing tactile cues where it is deemed unsafe or inappropriate
9. Intellectual Property
All content, programs, branding, and materials remain the intellectual property of Gem Pilates Studio and may not be reproduced without consent.
10. Changes to Services
We reserve the right to:

Change instructors, class schedules, or pricing

Modify these Terms at any time
Updated Terms will be available on our website or studio noticeboard.
11. Governing Law
These Terms are governed by the laws of Victoria, Australia.
